Role Responsibilities

The ideal candidate will have a strong background in personal injury law, a proven track record of success in litigating cases, and a passion for obtaining justice for clients who have suffered harm.

As our new Personal Injury Litigator, you will handle your own caseload of between 150-175 files with a view to progressing the files through to settlement or a final Hearing. This will be made up of cases that have fallen out of the Portal (RTA, EL or PL) or are excluded from the process under the rules. It will also include cases within the OIC process which require litigation.

Day to day responsibilities will include:

  • To manage a caseload of pre and post issue Fast Track and Multi Track claims to include OIC claims which require litigation.
  • To manage task lists and organise working day/week and ensure this is up to date at all times.
  • To receive new cases that have fallen out of the Portal or are excluded from this process under the Civil Procedure Rules.
  • To prepare and implement an “Initial Action Plan” on every EL and PL cases.
  • To prepare an “Evidence Action Plan” in every case and implement the plan of action agreed by the Associate Director.
  • To adequately prepare and collate evidence in readiness for litigation.
  • To fully quantify the claim and ensure that any subrogated losses are included and pursued, if relevant.
  • To fully investigate the injury claim and consider the question of rehabilitation.
  • To fully investigate liability and causation.
  • To attend Court (personally or by way of telephone) and perform advocacy for Case Management Conferences, Application Hearings.
  • To identify cases suitable for issue and to issue proceedings at the earliest opportunity.
  • To draft Pleadings, Application Notices, Disclosure Lists, Witness Statements, Part 35 Questions, Schedules of loss, Brief to counsel, Trial bundle index, Case summary.
  • To comply with supplier SLAs.
  • To value PI claims competently & utilising JC guidelines/case law where appropriate; to effectively investigate, collate/calculate and present special damages claims.
  • To establish and focus upon issues/facts in dispute in the context of liability; to utilise case law where necessary; to make effective use of Part 36.
  • To progress cases with the objective of maximising damages and cost recovery through issuing.
  • To comply with all rules, practice directions or court orders and where this is not possible, to apply to the court promptly to vary any such rule, practice direction or court order so as to minimise the sanctions imposed for non-compliance.
  • To regularly review the prospects of success and report back to the Associate Director in the event that this falls below 51%.
  • To keep clients regularly updated as to progress of the case.
  • To properly advise the client on settlement offers and take instructions promptly.
  • To ensure there is appropriate funding in place to cover the adverse costs of litigation and such funding is maintained throughout the course of the litigation.
  • To minimise any adverse costs orders and the firm’s exposure to write offs generally.
  • You may be required to perform any other duties and to work in any other areas as requested by the Company, if necessary, which may include other offices and those of clients.

What we need from you

  • Minimum 3 years’ experience in dealing with Personal injury claims preferred.
  • Solicitor, ILEX or experienced Litigation Fee Earner.
  • Experience of handling Fast Track PI cases from inception through to the issue of proceedings, settlement, and trial.
  • Experience of working in a legal, insurance or professional environment.
  • Strong understanding of current PI Procedures.
  • Ability to collect and assess evidence, determine prospects, provide appropriate advice to clients, and progress the claim efficiently.
  • Good comprehension skills relating to the understanding of a range of documents related to a case.
  • Excellent knowledge of civil procedure and tactics.
  • Ability to interpret and make effective use of Management Information.
  • Ability to prioritise workload and take decisions commensurate to the role.
  • A highly structured and organised approach to handling a large volume of cases.
  • An ability to work with a considerable amount of detailed information.
